This policy outlines the privacy practices of mSpy (www.mspy.com) and it applies solely to information collected by the mSpy website. It establishes the following:

  1. What personally identifiable information is collected from you through the web site; how it is used; and with whom it may be shared.
  2. Choices available to you regarding the use of your data.
  3. Security procedures in place to protect against the misuse of your information.
  4. How you can rectify any inaccuracies you may find in the information.

Information Collection, Use, and Sharing

mSpy is the sole owners of the information collected on this site and we only have access to or collect information that you voluntarily give us via email or through other direct contact from you. mSpy will not sell or rent this information to any other entity and it is solely for our own use.

mSpy will use the information you have provided in order to respond to you, in regards to the reason you contacted us. mSpy will not share your information with any third party outside of our organization, other than when necessary to fulfill your request, e.g. to complete shipment of an order.

It is necessary for mSpy to request personal information from you on our order form. In order to purchase our software products from us, you must provide contact information (such as your name and shipping address) and financial information (such as credit card number, expiration date). This information is used for billing purposes only and to fill your order. If we have any problem with the processing of your order, we will use this information for the purpose of contacting you.

Unless you request that we do not, we may contact you via email in the future in order to inform you of specials, new products or services, or changes to this privacy policy.


Your Access To And Control Over Information

  • Change/correct any data we may be in possession of related to you.

Security

We take all reasonable precautions to protect the privacy of your information. When you submit sensitive information via the mSpy website, your information is protected online as well as offline.

Wherever we collect sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure way. You can verify this by the presence of a closed lock icon at the bottom of your web browser, or seeing the letters "https" at the beginning of the URL address of the web page.

While we employ the use of encryption to protect sensitive information transmitted online, we also provide protection of your information offline. Only employees who require the information to perform a specific job (such as for billing or customer service) are granted access to personally identifiable information. The computers/servers in which we store your personally identifiable information are maintained in a secure environment.

Refund Policy

Your purchase of My Spy software is regulated by this policy. Please read it carefully before completing your order as it delineates your rights with regard to your purchases, including essential restrictions and exclusions. By placing an order you agree that your order is governed by this policy.

You must jailbreak the iPhone you want to monitor before installing this application. It is impossible to download or install My Spy if you can't jailbreak the target iPhone. To get the instructions on jailbreaking please go here. Please note that My Spy doesn't support Windows Phone 7 mobile devices yet.

General

If you are not fully satisfied with your purchase of My Spy software, you can be eligible for a full refund according to Refund Conditions outlined below. However, we are convinced that most of refunds can be avoided if you request professional help from our Customer Support.

Refund Conditions

Settle your doubts using My Spy application! Simply download this software and keep track on all activities on their phones.

My Spy software
  • Subject to this Refund Policy conditions, you may be eligible to receive a full refund within 10 days following the day of your purchase provided your reasons don't contradict with the Refund Policy conditions.
  • No refund will be available after this refund period is over.
  • The refund may apply only to the primary (first) My Spy subscription.
  • If you own more than one subscription, no refund will be available.
  • Your money may be refunded only once. If you buy another My Spy subscription at a later time, this will not be subject to a refund request.
  • No refund is due if the customer refuses to upgrade the My Spy version in the event of performed upgrade on the target phone.
Premium Support Services

mSpy offers Premium Support Services for customers seeking a highly personalized level of technical assistance (help with Android rooting, phone support, etc.). This optional service is non-refundable and costs $9.99 (one-time payment). Customers that do not select mSpy Premium Support at the checkout will continue to have access to the standard mSpy support options, offered at no additional charge.

Subscription Prolongation Non-refundable
Force majeure No refund can be granted to My Spy customers in case their reasons for a refund are completely beyond our control. They are the following:
  • The target phone doesn't have Internet access any longer (no money left on the target phone account, temporary service interruption, roaming-related problem etc).
  • If the carrier is changed by a target phone user which leads to the loss of internet connectivity and consequently improper functioning of My Spy application.
  • Update of operational system.
  • Resetting to original factory settings.
  • A customer doesn't follow the installation guidelines of our customer support team.
  • The customer does not have an access to the target phone.
  • If the customer didn't receive the previous data because My Spy hasn't been installed onto the target device initially.
  • If the target device is running on iOS 6.1.3, 6.1.4, iOS 7.1, Symbian Belle, Windows Phone OS, Bada OS or any other operating system, which is not listed in Compatibility section.
  • If the customer counted on using My Spy on more than one target device after buying one subscription plan.
  • Personal reasons ("I've changed my mind", "I've made a purchase by mistake", etc.).
  • A customer is either unable or unwilling to jailbreak their iPhone.
  • If a customer is not able to use WhatsApp, Skype, Viber, and Facebook features because the target Android deviсe is not rooted.

Refund Procedure

You are required to send your refund request to Billing Dpt. at refund@mspy.com. We do not accept refund requests made via a Live Chat or by phone. The refund decision is generally made within one or two business days.


SOFTWARE END USER LICENSING AGREEMENT (EULA)

PLEASE CAREFULLY REVIEW THIS LICENSING AGREEMENT PRIOR TO PURCHASING OR USING THE MSPY SOFTWARE. BY PURCHASING AND USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS LICENSE. IF YOU DO NOT AGREE TO THE TERMS OF THIS LICENSE, DO NOT INSTALL OR USE THE SOFTWARE AND DELETE THE SOFTWARE AND ALL OF ITS RELATED FILES FROM YOUR DEVICE.

This mobile device software, artwork, sound, and additional components included in this product (collectively referred to herein as the "Software") are the copyrighted property of mSpy and its licensing agents (collectively referred to as "mSpy”). This Software is licensed (not sold) to you, and mSpy owns and retains all copyrights, trade secrets, patents and all other proprietary rights included in the Software. You are licensed to use the Software on a single device. You may not: (1) copy (other than being in possession of one copy for backup purposes), distribute, rent, lease or sub-license all or any portion of the Software; (2) change, modify or prepare derivative works of the Software; (3) transmit the Software over a network, by telephone or electronically using any means; (4) reverse-engineer, disassemble or de-compile the Software.

You have the right to transfer the Software, but only if the recipient agrees to accept these terms and conditions outlined in this End User Licensing Agreement. In the event that you do transfer this Software, your license is automatically terminated and you are required to transfer all components, documentation and related files to the transferee while erasing any copies existing on a device onto which the software resides or has been installed by you.

You acknowledge and agree that the use of this Software is at your sole risk with the exception of the following 90-day limited, non-transferable warranty on the product:

mSpy agrees to warrant the original purchaser that the Software will be free from defects in material and workmanship under normal use for a period of 90 days from the date of purchase. If the Software proves to be defective, mSpy will replace the defective digital media free of charge to the purchaser, provided that the digital media proves to be defective within the 90-day period following the date of purchase.

The terms of this EULA are subject to change at any time, and in the event of any changes, the updated version of the licensing agreement will appear on this page.
